Terms Of Service Agreement

By subscribing to ConceptSurf.com service(s), you accept the terms and policies stated herein (Agreement).

The following is the service agreement between ConceptSurf.com (CONCEPTSURF) and the personal or corporate account holder (CUSTOMER).
  1. CONCEPTSURF agrees to provide CUSTOMER the hosting services based on the hosting plan that CUSTOMER has selected, in exchange for CUSTOMER paying the prescribed fees.

  2. CONCEPTSURF treats the disclosure of personal information very seriously. Please refer to "Privacy Policy" for more details.

  3. Any content on CUSTOMER's Web site that is prohibited by the laws of any sovereign state, obscene under the laws of any sovereign state, or otherwise considered by CONCEPTSURF, in its sole discretion, to be offensive, disruptive, obscene, inappropriate or otherwise an administrative burden, may be removed or deleted without any prior notice nor compensation to CUSTOMER.

  4. The CUSTOMER is solely responsible for all the contents stored on the servers, including the legality and preservation (i.e. making back-ups) of same. Please refer to "Acceptable Usage Policy (AUP)" for more details.

  5. If, in the determination of CONCEPTSURF, the hosted applications used by CUSTOMER poses an immediate threat to the physical integrity or performance of the servers, then CONCEPTSURF may perform such work and take such other actions that it may consider necessary without prior notice to the CUSTOMER and without liability for damage to the data for any interruption of the CUSTOMER's businesses.

  6. CUSTOMER agrees not to engage in any activity that can overwhelm the servers with heavy usage, or that requires a disproportionate amount of resources of its servers, including but not limited to, highly active CGI or chat scripts.

  7. Under no circumstances will CONCEPTSURF be obligated to provide insurance coverage for any program or data owned by the CUSTOMER.

  8. CUSTOMER agrees not to send any e-mail that is prohibited by the laws of any sovereign state, obscene under the laws of any sovereign state, or otherwise considered by CONCEPTSURF, in its sole discretion, to be offensive, disruptive, obscene or inappropriate.

  9. CUSTOMER agrees not to send any spam e-mail (i.e. unsolicited e-mail).

  10. CUSTOMER will at all times be liable for the safeguarding of CUSTOMER's password and account information.

  11. If CUSTOMER breach any term of this Agreement, CONCEPTSURF reserves the right to delete CUSTOMER's mailbox without any compensation.

  12. CUSTOMER must keep a personal backup copy of its software, sites, databases and all hosted content. CONCEPTSURF should not be held responsible of any loss of data or data corruption.

  13. CUSTOMER may request, CONCEPTSURF may at its option, technical and non-technical support, such as equipment reboots, troubleshooting, DNS and other support. CUSTOMER agrees to pay the hourly rate of SGD$200 for such services.

  14. Invoices will be sent to CUSTOMER via email. Upon request, CONCEPTSURF will send a copy of the invoice to your requested mailing address.

  15. Upon account activation, CUSTOMER must pay its account even if CUSTOMER is not making any use of it.

  16. First month payment must be paid before the commencement of the service. All other invoices must be paid by the CUSTOMER within 30 (thirty) days from the date of CONCEPTSURF's invoices or the last day of payment stated in the invoice (DueDate), whichever is earlier.

  17. After DueDate, CONCEPTSURF has the right to charge CUSTOMER a one time fee of SGD$50. Accounts that are not paid 30 (thirty) days after the DUEDATE will be cancelled by CONCEPTSURF without prior notice to the CUSTOMER.

  18. If the CUSTOMER is in default of any of its obligations under this Agreement, then CONCEPTSURF may in its sole discretion, without notice, suspend the service(s) provided.

  19. CONCEPTSURF only accepts PAYPAL payment method for payment outside of Singapore.

  20. Upon 30 (thirty) days or greater written notice prior to the end of the initial commitment, CONCEPTSURF may change any fees payable under this Agreement.

  21. Service upgrades can happen any time. However service downgrades can only happen on the account's anniversary date. E.g. if CUSTOMER's account is opened on the 5th May, then the service downgrades can only happen on the 5th of the month.

  22. Billing errors can be credited retroactively for a period of up to 2 (two) months.

  23. Limitation of Liability: CONCEPTSURF is not responsible for any failures, delays, or interruptions in the delivery of any content or services contained on the server, or losses or damages arising from the use of the content or services provided by CONCEPTSURF or third parties in connection with CONCEPTSURF. In no event will CONCEPTSURF be liable for any lost profits, special, indirect, consequential, incidental or punitive damages.

  24. Force Majeure: Neither party will be liable for any delay, interruption or failure in the performance of its obligations if caused by acts of God, war, declared or undeclared, fire, flood, storm, slide, earthquake, or other similar event beyond the control of the party affected (“Force Majeure”). If any Force Majeure occurs, the party claiming the Force Majeure will promptly notify the other. The party claiming the Force Majeure will use commercially reasonable efforts to eliminate or remedy the Force Majeure. This Section will not apply to excuse a failure to make any payment when due.

  25. If any portion of this Agreement is determined to be or becomes unenforceable or illegal, such portion will be reformed to the minimum extent necessary in order for this Agreement to remain in effect in accordance with its terms as modified by such reformation.

  26. Complaints or Agreement & AUP violations must be reported to us by email at: abuse@ConceptSurf.com.

  27. CONCEPTSURF may vary these rules and regulations from time to time in its sole discretion, and the CUSTOMER will comply with all other reasonable security requirements that CONCEPTSURF may impose, provided that the CUSTOMER has been given 30 (thirty) days notice.

  28. CUSTOMER agrees to abide by any amendments made to this Agreement, from time to time, as posted at www.ConceptSurf.com.
